Our policy, and we ourselves, guarantee that all necessary precautions are taken to protect all of your data against disclosure, loss, or alteration. This is why we provide you with all the information you need to clearly understand how we process your data. Your personal data may be collected when you visit the petsyandpet.com Site using cookies, create a customer account on the petsyandpet.com Site, place an order for one of our products or services, or agree to subscribe to our newsletters (SMS, emails).

Your personal data helps us make your browsing experience on the petsyandpet.com Site smoother and more personalized. We may therefore process your orders more efficiently, provide installment payment options, prevent fraud, carry out necessary refunds, and manage customer reviews.

3.2. Your browsing on the petsyandpet.com Site
In order to enable you to browse the petsyandpet.com Site, we process your data on the legal basis of your consent.

3.3. Processing your orders
In order to manage and process your orders, we use your data.
We use it to handle mediation, customer relations (including through social media), after-sales service and distance selling, our marketing and commercial prospecting activities for the petsyandpet.com Site, as well as order management, delivery, and transportation.

The performance of the contract between the two parties (you and us) is the legal basis for this data processing.

The legal obligation of petsyandpet.com is the legal basis for processing related to product recall management. Your consent or our legitimate interest may, depending on the case, form the legal basis for marketing and commercial prospecting actions. Your consent is the basis for implementing “flash” payment.

3.4. Payment in installments
For orders eligible for installment payments and for certain customers, your data is processed in order to offer you this payment option. The performance of the contract between the two parties is the legal basis for this processing. However, your consent remains the basis for processing your banking data.

3.4.1 Klarna
In order to offer Klarna’s payment options, we may need to transfer your personal data, including your contact details and order details, to Klarna so that Klarna can assess whether you qualify for these options and tailor them to your needs. The personal data transferred will be processed in accordance with Klarna’s privacy policy.

3.5. Customer reviews
In order to share your reviews with our customers and visitors and allow you to leave reviews on the petsyandpet.com Site, we use your data on the legal basis of your consent or our legitimate interest.

3.6. Payment collection and fraud prevention
In order to recover payments and fight fraud, we use your data.
This also allows us to guarantee payment security.

The performance of the contract between the two parties and the legitimate interest of petsyandpet.com, as data controller, are the legal bases for this processing.

3.7. Advertising operations of petsyandpet.com
The advertising operations of petsyandpet.com are managed through the use of your data.
This allows us to increase our customer and prospect database, manage maintenance and technical prospecting activities, produce commercial statistics and advertising campaign studies, update prospecting files maintained by the body responsible for managing opposition to telephone marketing, carry out solicitations, organize competitions and lotteries or any other promotional operations excluding online gambling.

The legal bases for the above-mentioned operations are the user’s consent or the legitimate interest of petsyandpet.com.

WHERE DOES YOUR DATA GO?

Your data is transmitted to several internal departments of petsyandpet.com.

It is not sent to third parties except in the situations specified below:
In order to process your orders, your personal data may be transmitted to several service providers specializing in banking transactions, customer relations, after-sales service, delivery, IT development, website management, or the provision of warranties or insurance.

For installment payment implementation, your data may be shared with service providers such as payment and transaction centers (banks, etc.), call centers for managing business processes or customer experience, or, for customer reviews, with a provider responsible for collecting and processing customer reviews.

The advertising operations of petsyandpet.com are managed, using your data, by advertising clients and advertisers.

The data collected by petsyandpet.com is kept only for the period and purposes necessary for carrying out the operations mentioned in paragraph 3 of our personal data policy.

We retain certain data collected by petsyandpet.com for a specific period:

In active archives for prospects, for 3 years from the last contact with the customer (during which time it remains accessible to petsyandpet.com services). We do not carry out intermediate archiving of this data (for data of administrative interest to certain services, such as litigation, retention periods are determined by applicable limitation rules).

For orders, your data will be archived in active archives for 5 years from the end of the use of the customer’s orders, and in intermediate archives for 5 years from the end of storage in active archives. The same applies to customers.

As for banking data, it is archived in active archives for the entire validity period of the bank card (plus one day). No intermediate archiving is carried out for banking data.

Cookies, their use, and duration are detailed in paragraph 7 of this policy.

Or, where you believe that our use of your personal data is unlawful and you request a restriction of its use rather than deletion. We may also no longer need to use your data for the purposes mentioned in paragraph 3, but your data may still be useful for the establishment, exercise, or defense of legal claims, or where you exercise your right to object during the period required to verify whether the legitimate grounds we pursue override yours.

6.3. You have the right to request deletion of your Data.
If you request the deletion of your personal data, petsyandpet.com may nevertheless retain it in intermediate archives for the time necessary to comply with its legal, accounting, and tax obligations.

If no such instructions exist, your successors and heirs may contact petsyandpet.com to access the use of this data in order to organize and settle the deceased person’s estate and/or close the account on the site and/or request the cessation of personal data processing.
You may also request that your data not be disclosed to a third party in the event of your death.

6.6. You have the right to data portability.

To exercise your rights, please send your request (accompanied by your email address, surname, first name, copy of your identity document, and postal address) to the petsyandpet.com data protection department by email at contact@petsyandpet.com and/or by post to petsyandpet.com.

We will respond within a maximum period of one (1) month from the date of receipt of the request.

TRANSFERS OUTSIDE THE EUROPEAN UNION

Most of the time, your data is stored within the European Union.
However, when our service providers are located in countries outside the European Union, we may share some of your data with third countries, including countries where the European Commission has not carried out an adequacy assessment.

In such cases, we take the necessary steps to ensure that this data sharing is carried out in compliance with the applicable regulations and that your privacy and fundamental rights are protected, for example through the use of the European Commission’s standard contractual clauses.

The data protection department may, upon request, provide you with more information about these data transfers.

SECURITY MEASURES

Thanks to the technical and organizational measures we implement, we are able to guarantee a level of security appropriate to the risks to the rights and freedoms of individuals referred to in point 2. To achieve this, we take into account the origin, scope, context, costs, state of knowledge, purposes of the processing, and the identified risks.

In addition, we comply with the PCI DSS payment card industry security standard, which reflects our commitment to security.

PROFILING AND AUTOMATED DECISION-MAKING

As a result of the automated processing we use (such as profiling), you may be subject to legal effects that affect you.
This is necessary for the conclusion or performance of the contract binding you to us.

This is how we are able to offer and perform automated customer identification and “pay in 4 installments.” The basis for this operation relates to the analysis of different variables concerning the type of products, services ordered, or the customer profile.

If, based on these statistics, the risk is considered too high (fraud/unpaid amount), then this payment option will not be offered.

However, if you wish, you may obtain human intervention even though the decisions are automated, and you may give your point of view and/or object to the automated decision.

POLICY UPDATES AND REVIEW

Our personal data policy will be updated whenever necessary in order to remain compliant with the regulations applicable to the protection of your data, and at least every three (3) years.
